Online Booking and Vehicle Rental Terms

These draft terms reflect the implemented online reservation, authorization, confirmation and cancellation process. They are incomplete until the commercial and physical-rental conditions listed below are approved.

Do not enable production checkout using this draft. Austrian counsel should review the final German text, especially fees, damage, insurance, liability, withdrawal and jurisdiction clauses.

Commercial terms still required

  • Insert the GISA number and competent trade authority, and verify the exact registered trade wording against the GISA extract.
  • Whether displayed prices include VAT and every mandatory charge; mileage, fuel/charging and one-way rules.
  • Insurance cover, excess/deductible, security deposit, damage assessment, accident and theft procedure.
  • No-show, late pickup, late return, extension, early-return and cleaning/refuelling charges.
  • Permitted countries, cross-border use, prohibited uses, roadside assistance and replacement-vehicle rules.

1. Scope and rental provider

These terms govern online booking and, once accepted, the vehicle rental provided by Khaled Mamahmadi, operating under the business designation RentCars24. RentCars24 is a business designation and not a separate legal person.

The rental provider’s business address is Logistikstraße 7, 7D, 2201 Hagenbrunn, Austria.

Mandatory consumer rights under Austrian and EU law remain unaffected. No handover document may introduce unexpected material charges or restrictions that were not made available before the online contract was concluded.

2. Driver eligibility and information

  • The primary driver must be at least 18 years old at the scheduled pickup time.
  • The driving licence must be valid through the scheduled return date and accepted for driving the booked vehicle in Austria.
  • The driver must provide accurate contact, date-of-birth and licence information and present the required original documents at pickup.
  • Only the verified primary driver may drive unless additional-driver terms are introduced and accepted before booking.

Identity-document, licence-tenure, vehicle-class and additional-driver requirements still need business and legal approval.

3. Offer, vehicle and availability

The review page shows the vehicle, rental period, pickup location, selected rate plan and server-calculated total. Availability and price are checked again at checkout. A temporary hold does not itself confirm a booking.

If the selected vehicle cannot be supplied, RentCars24 may offer an equivalent or upgraded replacement for the customer’s approval. If no acceptable replacement is agreed, the company may cancel and provide full financial remediation.

4. Reservation request and contract formation

Submitting checkout and completing Stripe creates a payment authorization and a pending reservation request. It does not by itself mean that the rental is confirmed.

The booking becomes confirmed when RentCars24 accepts the reservation and successfully captures the authorized amount. A confirmation email and the customer booking page provide the durable booking record. If the request is rejected or expires before acceptance, the authorization is released.

5. Price and payment

  • The server, not the browser, calculates the booking amount from the vehicle, duration and selected rate plan.
  • Stripe hosts the card-payment page. RentCars24 receives payment identifiers and status, not the complete card number.
  • The full displayed amount is authorized at checkout and captured only after the reservation is accepted.
  • No security deposit is currently charged through the implemented online checkout. Any future deposit must be separately disclosed before booking.

Before publication, confirm that the checkout total includes VAT and all unavoidable charges. EU consumer information rules require the total price to be clear before the customer is bound.

6. Customer cancellation and refunds

The selected Flexible or Non-refundable rate plan and the exact cancellation deadline shown at checkout form part of the booking. The separate Cancellation and Refund Policy is incorporated into these terms.

Specific-date car-rental services may be excluded from the ordinary 14-day distance-contract withdrawal right. Contractual cancellation rights therefore depend on the selected rate plan, without limiting other mandatory statutory remedies.

7. Rejection or cancellation by RentCars24

RentCars24 may reject a pending request or cancel a booking when it cannot fulfil the rental, the vehicle becomes unavailable, an operational failure occurs, payment integrity requires remediation or a genuine security issue exists.

When RentCars24 rejects or cancels for those reasons, it will release the full authorization or refund the remaining captured booking amount, irrespective of whether the customer selected a Non-refundable rate.

8. Pickup, use and return

The customer must arrive at the agreed location and time with the required original documents. The vehicle must be used lawfully, with reasonable care, and returned at the agreed location and time.

Detailed mileage, fuel or charging, condition report, permitted territory, accident, breakdown, damage, insurance, excess, fines, tolls, cleaning, late-return and extension rules must be inserted before these terms can become the complete rental contract.

This is a launch blocker. Material vehicle-use and financial conditions cannot first be introduced only at physical handover.

9. Customer responsibilities

  • Provide complete and accurate booking and driver information and promptly report changes.
  • Protect account, guest-access and booking credentials and notify RentCars24 of suspected misuse.
  • Inspect the vehicle with the provider at handover and return and report accidents, theft, warnings or damage promptly.
  • Comply with road traffic, parking, toll and vehicle-use laws and the final approved rental conditions.

10. Liability and mandatory rights

Liability is governed by applicable law and the final approved insurance and damage provisions. Nothing in these terms excludes liability that cannot legally be excluded, including mandatory consumer rights.

Any limitation must be proportionate, transparent and reviewed under Austrian consumer law. A blanket exclusion of company liability or an unlimited right to impose charges is not intended.

11. Electronic communication and contract record

Customers agree to receive transactional booking, payment, access and cancellation communications at the supplied email address. The selected rate-plan version, price, cancellation deadline and legal-document versions are retained with the booking.

Customers should save the confirmation email and linked documents. Marketing email requires a separate legal basis and is not covered by acceptance of these terms.

12. Complaints, applicable law and disputes

Complaints should first be sent to rentcars24austria@gmail.com or made by telephone at +43 688 6072 6075. Austrian law is intended to apply, but this choice must not deprive consumers of mandatory protections available in their country of residence.

Any jurisdiction or alternative-dispute-resolution wording must be reviewed for the final legal entity and target markets. The discontinued EU Online Dispute Resolution platform must not be referenced.

13. Versions and changes

The version accepted during checkout governs that booking together with its immutable price and cancellation snapshot. Later changes apply only prospectively unless the customer expressly agrees or mandatory law requires otherwise.

If one clause is ineffective, the remaining terms continue only to the extent permitted by applicable law; an ineffective clause is not replaced by a term that disadvantages the consumer beyond the law.
